Festival Ticket Purchase Policy, Terms and Conditions, and Liability Waiver
I. COVID-19/COMMUNICABLE DISEASE: Assumption of Risk and Waiver
COVID-19 is a highly transmissible disease that can lead to severe illness and death. An inherent risk of exposure to COVID-19 exists in any public place where people are present, regardless of precautions that may be in place.
By purchasing an admission ticket(s), and attending Milwaukee Irish Fest, you, as the ticket holder, and on behalf of any accompanying parties, as well as on behalf of any individual who uses a ticket purchased by you, acknowledge and voluntarily assume any and all risks, hazards, and dangers arising from or related in any way to the risk of contracting COVID-19 or any other communicable or infectious disease or illness, virus, bacteria, or other pathogen capable of causing a communicable disease or illness, whether occurring before, during, or after Milwaukee Irish Fest, however caused or contracted, and voluntarily on your own behalf and on behalf of your heirs, executors, personal representatives, administrators, and assigns, agree to forever waive, covenant not to sue, release, and discharge the Released Parties, named below, from any and all liability, claims, causes of action, damages, costs, or expenses of every kind, including all claims and causes of action based on the sole, joint, active or passive negligence of any of the Released Parties, arising out of or in any way relating to the exposure to COVID-19 and any other communicable or infectious disease during your visit to Milwaukee Irish Fest. Released Parties: The City and County of Milwaukee, the Event Organizers, and their affiliated companies and all officers, directors, employees, agencies, contractors, sub-contractors, representatives, assigns, insurers, and volunteers of each entity.
The ticket holder further acknowledges, understands, and confirms that no precautions can eliminate the risk of exposure or contraction of COVID-19 or any other communicable disease, and that it cannot be guaranteed that you, any accompanying party, or individual who uses a ticket purchased by you, will not be exposed, and that as such, potential exposure and contraction are inherent risks of your decision to purchase and use your ticket(s).
By purchasing a ticket(s), you, and on behalf of any accompanying parties, as well as on behalf of any individual who uses a ticket purchased by you, agree to comply with all health and safety policies, protocols and precautions of Milwaukee Irish Fest and its venue owner/operator, and all other policies and terms and conditions set forth here, and at irishfest.com/policies, consent to precautions related to COVID-19 that may be required as a condition of use of this ticket(s), such as but not limited to, social distancing requirements, mask requirements or recommendations of mask use in designated areas, and acknowledges that policies, protocols and precautions may be updated between the time of purchase of your ticket(s) and attendance at Milwaukee Irish Fest, due to the evolving nature of the COVID-19 pandemic with Milwaukee Irish Fest, or any such designee, also having the right to deny admission to, or eject any person(s) who poses a risk or threat to the health or safety of others and/or whose conduct violates these terms.
II. FESTIVAL ADMISSION/TICKETS
To enter the Henry Maier Festival Grounds during Milwaukee Irish Fest a valid admission ticket is required. Admission tickets are limited and subject to capacity restrictions. All sales are final and non-transferable. Resale of this or any ticket is strictly prohibited. Entrance is subject to the policies and restrictions posted at each entrance to the grounds. The facility reserves the right to refuse admission or eject any person violating any law or policy. Milwaukee Irish Fest reserves the right to alter policies and restrictions at any time.
Consent: Persons entering the facility hereby consent to having their name, image and/or likeness, writings, biographical information, recordings or their voice captured or reproduced in any medium, for any purpose by Milwaukee Irish Fest or its affiliates, respective licenses and assigns, partner or the medias.
Tickets are nontransferable and nonrefundable.
III. LIABILITY
Entrance to Milwaukee Irish Fest at the Henry Maier Festival Park is at your own risk. Milwaukee Irish Fest is immune from liability for any injury, loss, claims, costs, expenses or damage (collectively “Claims”) which may be suffered or incurred, or which may arise directly or indirectly in respect to the supply of goods or services, or the ticket holder’s attendance at Milwaukee Irish Fest, including liability for negligence pursuant to Wisconsin Statute 895.52.
Each patron indemnifies Milwaukee Irish Fest in respect of all Claims made in connection with their attendance at the Event and, to the full extent permitted by law, each patron releases and discharges Milwaukee Irish Fest, its employees and all other persons involved in the organization, sponsorship and promotion of the Event, its affiliates and volunteers from all such Claims.
The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable.
Use of the Website—By accessing the website, you warrant and represent to the website owner that you are legally entitled to do so and to make use of information made available via the website.
Trademarks—The trademarks, names, logos and service marks (collectively “trademarks”) displayed on this website are registered and unregistered trademarks of the website owner. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of the website owner.
External links—External links may be provided for your convenience, but they are beyond the control of the website owner and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk.
Warranties—The website owner makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website.

Applicable laws (choice of venue and forum)—Use of this website shall in all respects be governed by the laws of the state of Wisconsin, U.S., regardless of the laws that might be applicable under principles of conflicts of law. The parties agree that the Wisconsin courts located in Milwaukee county, Wisconsin, shall have exclusive jurisdiction over all controversies arising under this agreement and agree that venue is proper in those courts.
